Home Protection Trust

home protection trust

A home protection trust, also known as a property protection trust or a family protection trust.

It is a type of trust that is designed to protect your home and other assets from various risks and potential claims from creditors.

The general concept of a home protection trust involves transferring ownership of your property into a trust while still retaining the right to live in the property during your lifetime.

Here’s how a typical home protection trust works:

  1. Creation of the trust: You would establish the trust by working with an expert, experienced in estate planning. The trust document will outline the terms and conditions of the trust, including who the beneficiaries are and how the property will be managed.

  2. Transfer of ownership: You would transfer legal ownership of your home into the trust. This means that the property is no longer considered your personal asset but is owned by the trust instead. As the creator of the trust, you can have control over adding or removing Trustees and Beneficiaries and specify yourself as a discretionary beneficiary, allowing yourself to continue living in the home during your lifetime.

  3. Appointment of trustees: You would appoint two or more trustees to manage the trust and the property. The trustees are responsible for ensuring that the terms of the trust are followed and that the property is protected. You will be able to name yourself as a Trustee.

  4. Protection of assets: By transferring ownership of your home to the trust, it is no longer considered your personal asset. This can provide protection against various future risks and also enable the trustees to pass the asset to beneficiaries quickly and efficiently after your death.

  5. Beneficiary designation: You would designate beneficiaries who will inherit the property upon your death. These beneficiaries can include family members, loved ones, or other individuals you choose.

It’s important to note that home protection trusts are subject to legal and financial considerations, and their effectiveness can vary depending on your individual circumstances. Consulting with an expert  experienced in estate planning and trust law is essential to understand the specific rules and requirements, to ensure that the trust is properly set up and administered.

Additionally, it’s worth mentioning that home protection trusts are not suitable for everyone, and their appropriateness should be evaluated based on your unique situation and goals.

Professional advice should be sought to determine if a home protection trust is the right option for you.
